David Altschuler focuses his practice in representing insurers in complex insurance coverage and bad faith litigation in state and federal courts nationwide. David addresses coverage issues for underlying claims ranging from mass torts and pollution losses to actions against design professionals involving some of the largest construction projects in the country and internationally and claims against attorneys, accountants, real estate brokers and other professionals.
His practice includes representing insurers on claims arising under various insurance policies, including commercial general liability, umbrella and excess, project-specific coverage, professional liability, trucking liability and commercial property. David also advises clients in the development of new insurance products and drafting policy forms, exclusions and endorsements, and represents insurers in class action litigation and regulatory proceedings.

Experience
- Represented London market insurers in a lawsuit in Franklin County, Ohio, regarding long-tail claim for insurance coverage under historic excess-level third-party liability policies for costs electric utility entities paid in connection with federal and state regulations, including the Environmental Protection Agency “CCR Rule,” relating to disposal of coal combustion residuals.
- Represented a London-based surplus lines insurer in 10 lawsuits in the United States District Court for the District of Maryland for rescission of liability policies based on misrepresentations in the applications for the policies.
- Defended a class action against an auto insurer in Florida seeking “double damages” for alleged violations of the Medicare Secondary Payer Act and the Florida Medicaid Program.
- Successfully represented a shareholder of a closely held corporation in a lawsuit in the Southern District of Illinois in a dispute over the rightful ownership of the company.
- Represented an auto insurer in an enforcement action before the Minnesota Department of Commerce.
- Represented an insurer client in an action in Washington State involving coverage for water infiltration under a “wrap” policy.
- Represented an insurer client in reaching a mediated settlement of a construction defect claim under a CCIP policy in Montana.
