Bankruptcy & Reorganization
Our Bankruptcy and Reorganization attorneys provide insurers with comprehensive advice on minimizing exposure in the event of an insured’s bankruptcy. Combining deep experience in both bankruptcy and insurance law, we regularly assist clients nationwide in navigating the complexities of policyholder and other bankruptcies, including significant Chapter 11 filings. The intersection of bankruptcy and insurance law is extraordinarily complex, and very few firms practice successfully in this area.
We represent a wide range of domestic and foreign insurers, offering guidance on matters such as claims handling, and drafting pleadings and motions related to insurance, financing, sales, and reorganization plans. Our attorneys also negotiate and document collateral settlements and buyback programs, ensuring compliance with bankruptcy court requirements.
Our practice is equipped to handle the demanding nature of bankruptcy litigation. From trial courts to appellate courts, we represent insurers in cases involving asbestos, silica, environmental, opioid, sexual abuse, and other mass tort liabilities. We also represent secured and unsecured creditors in a wide range of bankruptcy litigation, including plan and disclosure statement objections, preference and fraudulent transfer defense, and loan servicing issues. With expedited discovery and tight filing deadlines as common challenges, our team's experience allows us to advocate effectively for our clients even under constrained timeframes.
