Biography
Russell Webb Roten practices in federal and state courts throughout the United States. Russell represents clients in a variety of insurance and bankruptcy matters. He has tried numerous jury and court cases to verdict, has handled large bankruptcy cases for insurers, and has resolved cases in arbitration and mediation. He works with his clients to attain the clients’ objectives in the best, most cost-effective way possible.

- Represented insurers in the following Diocesan bankruptcy cases, all of which resulted in settlements approved by the Bankruptcy Courts: Rockville Centre NY; Portland, OR; Wilmington DE; Milwaukee WI; St. Paul and Minneapolis, MN; Winona, MN; Harrisburg, PA; Helena MT.
- Currently representing insurers in thirteen Diocesan bankruptcy cases in California, New York, and New Jersey.
- Currently representing insurers in complex asbestos bankruptcy cases in North Carolina, Delaware, and Texas, having done so in approximately thirty cases over more than twenty years, often opposing prejudicial plans of reorganization and protecting insurers’ rights.
- Negotiated pre-bankruptcy settlement and obtained bankruptcy court approval of settlement and injunction against future claims.
- Obtained a favorable judgment for insurers in a declaratory relief action concerning the scope of a policy buyback agreement, with potentially $3.4 billion of coverage at issue.
- Won a jury trial in Texas as to the reasonableness of the amounts proposed to be paid to asbestos claimants.
- Negotiated favorable settlements of two cases alleging broker negligence and related claims.

The bankruptcy group focuses its nationwide practice on representing the insurance industry, complementing Skarzynski Marick’s highly regarded insurance coverage litigation practice. They join from Duane Morris.
